Florida Legal Funding, LLC

Am I eligible for funding? Yes, if you have been injured as a result of an auto accident, slip and fall, medical malpractice, product liability or workers compensation case and you are represented by an attorney, you may be eligible of advance funding against your lawsuit. However, the final determination is made on a case-by-case basis.

Is this a loan? No. This is what is know as Non-Recourse Funding. Florida Legal Funding, LLC is purchasing a lien interest in your settlement. Unlike a loan, if you lose your case you owe us nothing.

How long does it take for me to get the money? Florida Legal Funding, LLC will wire or overnight mail the funds to you the same day you are approved for funding and you and your attorney complete all necessary documents. Usually, this can take place within 72 hours of application.

Will I owe any up-front fees? No. Payment is due upon settlement of your case. At that time your attorney will handle repayment of the advance.

What if I lose my Case? If you lose your case you owe Florida Legal Funding, LLC nothing.

Do you get involved in my case? No. Your attorney and you will make all decisions relative to your case. Florida Legal Funding, LLC does not and will not interfere with your lawsuit.

Why can’t my attorney give me money? The Florida Bar has consistently held that a lawyer may not advance living expenses to a client pending settlement and collection of a claim. See, Opinion 65-39, issued June 15, 1965.

How much can I get? This will differ on a case-by-case basis. Generally, Florida Legal Funding, LLC will not advance more than 10% of the estimated value of pending cases and 25% of the estimated value of settled/judgment cases (minimum $1,000).

Is this Usury? No. Florida Legal Funding, LLC bears the risk that your case may be worthless. If you lose your case you do not have to re-pay Florida Legal Funding, LLC. Therefore, this is not a loan.

Should I seek advice from my attorney regarding funding? Yes. It is imperative that you discuss this matter with your attorney prior to entering into any type of agreement. In some situations there are alternative sources of funding that you may be entitled to which your attorney can help you with: Such as lost wages under the Personal Injury Protection (PIP) policy or lump sum advance on a workers compensation case among others. You should discuss alternative funding with your attorney.

Are your services expensive? Yes. If you have any alternative sources of income to meet your immediate needs you should utilize them. Florida Legal Funding, LLC is taking a risk by providing you funding against a contingent case in order to offset the risk the cost is high.

Do I need good credit to qualify for funding? No. Infact, your credit has very little to do with whether your case is funded.
